JOHN HOOD, GARAGE SETBACK: Mr. Hood proposes to build a garage near a corner of his property, located at 428 River Road. The proposed structure would be 40 ft X 40 ft and would be used for working on farm equipment. Due to ledge and a steep drop-off behind the location, he is having trouble meeting the required 75-foot setback from the road. He is able to meet the setback from neighbor Albert Cole’s property line. Mr. Hood requested a meeting with the Planning Board to seek approval to reduce the setback.
Article 5, Note (D) of the Dayton Zoning Ordinance states: “Where a proposed structure is abutted on both sides by existing structures whose setback from the road is less than the required setback, the setback of the proposed structure may be reduced to that of the abutting structures upon approval of the Planning Board in accordance with the provisions of Article 6.”
Neither abutting structure (John Hood’s farm house and Albert Cole’s residence) meet the required setback from the road, as both are less than 50 feet. Mr. Hood stated that he had met with Albert Cole, who had no objection to the proposed garage and had helped him measure the distance from the center of the road.
Remi Caron motioned to allow Mr. Hood to reduce the front setback for his garage from 75 feet to 50 feet. Dan Plourde seconded; all voted in favor. An approval was written, signed by Chair Rand Clark and given to Mr. Hood.
The meeting adjourned at 7:30 PM. The next meeting will be held on Tuesday, May 20, 2014, 7:00 PM at Dayton Town Hall.
