DAYTON PLANNING BOARD
Regular Meeting
June 5, 2006

Members Present: Nancy Harriman (Chair), Dick Hall, Rick Shaw, Derrick Vezina, Ron Wormwood, Valerie Cole (Alt.)

Administrative: Nancy Harriman called the meeting to order at 7:55 PM.

OLD BUSINESS:
LINWOOD ACRES SUBDIVISION:
The following issues from the public hearing were discussed:
1.      Fire Department wants the subdivision to have two cisterns. Both Boards agreed, citing the need for residents’ safety. Both Boards also agreed that the towns’ codes need to be reviewed with respect to the Fire Department’s recommendations. Ron Stewart noted that the State should also look at the road, as the speed limit changes from 25 mph to 35 mph at that location and there is much traffic.
2.      Hammerheads will be allowed but must be 80 feet.
3.      Lot A will be designated by a number, not a letter. Because it is an existing lot it does not have to adhere to subdivision restrictions.
4.      Two test pits per lot will be dug; Plumbing Inspector Mike Polakewich will be notified 48 hours in advance of further testing.
5.      The Board would like a right-of-way to the Walker land. This could be an extension of the road or could be located between lots 8 and 9 or 7 and 8. Right-of-way does not mean it has to be a road; it can be defined on a map. Applicants are willing to do so. Andy Morrell pointed out that the surveyor’s note on the plans indicates that he has no real information on this.
6.      Open space: the Board has talked about either requiring 10% of the land in open space or deferring that into a cash donation to a land acquisition fund, but the Planning Board needs to research this further.
7.      Maine DOT will be asked to do a traffic study on this section of road.
8.      The location of the nearby shooting range should be disclosed to potential buyers. (The concern about possible lead contamination of the soil has proven unfounded at other locations.)
9.      The entrance to Lot 1 will be on Apple Blossom Lane instead of Route 35.
10.     Width of the road: 25 feet is required by code (20 feet road and 5 feet of elevated sidewalk), the Board discussed having 24 feet of paved road with a painted line marking a 5-foot wide lane for walking and biking, and waiving the sidewalk requirement.  As this will be a private road, school buses won't be entering. Shoulders are still required to be three feet in width. The applicants questioned whether they would be required to pave the road, as the Planning Board decided to make this a requirement of all subdivisions after they had put in their application. Dick Hall will check with an attorney about this.
11.     Deeryards: a current study can be requested by the CEO through Inland Fisheries, State rules will prevail.
12.     Wetlands: this is the State’s responsibility to determine.
13.     Soils: this will be left to the State also.  
14.     Village district lines: the Board needs to have a clearly defined line. Ron Wormwood will ask the Selectmen if a surveyor can be hired to determine the line.

At this point no further public hearings are planned.

COMPREHENSIVE PLAN:
Selectman Ed LeBlanc informed the Board that the State Planning Commission is being dissolved. The Selectman will attempt one more time to get approval for the Dayton Comprehensive Plan. If it does not get state approval, the Town may choose to leave it as is.

NEW BUSINESS
LEGAL COUNSEL:
Ed LeBlanc told members that they can contact Glenn Anderson for legal counsel until a new attorney is retained.

Ron Wormwood motioned to adjourn the meeting at 8:43PM. Dick Hall seconded, all voted in favor.
The next regular meeting is Monday, June 19, 2006 at 7:00 PM at Dayton Town Hall.
